1. About these terms

These terms are an agreement between you and Investwise BV (“we”) about the LoudNow app and this website. By installing or using LoudNow you agree to them. Google Play’s own terms also apply to downloading and buying the app.

2. What LoudNow does, and what it cannot do

LoudNow watches the notifications on your Android phone and, when one contains a phrase you chose from a sender you allowed — or is from a sender you chose to let through entirely — reads it aloud on the alarm channel, vibrates and can flash the camera light.

It can miss or delay an alert when, for example:

• a notification arrives late or not at all, for instance because the sending app needs an internet connection and your phone is offline;
• your phone is off, out of battery, or Android stops apps running in the background;
• notification access is switched off, the alarm volume is at zero, or text-to-speech is not working;
• an app shortens or rewords its notifications, so your phrase is not in the text;
• the sender is not on your list, or the phrase is written differently.

LoudNow does not replace the alarms of other devices or apps. If you use a glucose monitor, a fall detector or a similar device, keep its own alarms switched on.

3. Your part

• Set up your phrases and senders with care, and use the test alert to check that you can hear it.
• Keep an eye on the daily “still watching” check-in, and fix any warning the app shows.
• Use LoudNow only on phones you own or are allowed to manage, and follow the law where you live.

4. Your licence

We give you a personal, non-exclusive, non-transferable licence to install and use LoudNow on Android devices you own or control, in line with Google Play’s terms. You may not sell, rent or redistribute the app, or copy, decompile or modify it, except where the law allows you to.

5. Plans and payment

• Free costs nothing and includes two phrases, each with its own alarm sound. Pro is a one-time purchase at the price shown in Google Play. It does not renew and there is nothing to cancel.
• The purchase is made and paid through Google Play, at the price shown there, including VAT where it applies. It is handled in Google Play, not in the app.
• Nothing you saved is ever deleted. Without Pro you are on the Free plan: two phrases, which you choose, each keeping its own alert sound, but without the Pro extras (its hours, its wording). Every other phrase and setting is kept and applies again if you buy Pro.
• While more phrases are stored than Free includes and you have not yet chosen which one stays active, no phrase will alert you. The app tells you this on your phone and in the app. It does not choose for you.
• Refunds are handled by Google Play under its refund policy. This does not affect your legal rights as a consumer.
• Pro applies to the Google account you bought it with, and includes features we add later.

6. Changes to the app

We may update LoudNow, add or change features, or fix problems. We aim to keep the features you paid for working. If we ever have to stop offering the app, we will tell you in advance where we can.

7. Liability

We build LoudNow carefully, but we cannot promise that it will work without interruption or that it will catch every notification. As far as the law allows, we are not liable for loss or damage caused by an alert that was missed, delayed or raised by mistake, and our total liability is limited to the amount you paid for LoudNow in the 12 months before the claim.

Nothing in these terms limits liability that the law does not allow us to limit, such as for death or personal injury caused by our negligence, or for fraud, and nothing affects your mandatory rights as a consumer.

8. Privacy

How LoudNow handles your data is described in our privacy policy. In short: your notifications are checked on your phone, and the app has no internet access.

9. Governing law

These terms are governed by Dutch law. If you live in another country, you keep the protection of the mandatory consumer law of that country. Disputes go to the competent court in the Netherlands, or in your country of residence if the law says so.

10. Changes to these terms

We may update these terms. We will change the date at the top, and for important changes we will also tell you in the app. If you keep using LoudNow after a change, the new terms apply.
